TERMS AND CONDITIONS
The words and phrases listed below shall bear the following meanings in these terms and conditions, unless the context clearly indicates otherwise:
1.1 “customer” and “customers” means any party to whom the premium rated SMS services are made available by SMS Competition;
1.2 “network operator” means any party licensed to install, operate, and maintain a cellular telephony network in the territory, and will include Cell-C, MTN, and Vodacom;
1.3 “premium rated service numbers” and “PRS numbers” means the five-digit short code numbers (e.g. 34010) and includes both dedicated and shared short codes;
1.4 “SMS” means a short message service provided by means of a text or data message to the cellular handset either on request of the handset user or via a pre-configured batch process;
1.5 “territory” means the Republic of South Africa;
1.6 “WASPA” means the Wireless Application Service Providers’ Association of South Africa.
Instructions on how to enter and other details contained within promotional advertisements for this competition form part of the conditions of entry.
Entry into the competition signifies acceptance of all conditions. Entrants are required to abide by the Terms and Conditions as presented.
The Terms and Conditions of this competition are governed by the laws of South Africa, in the Consumer Protection Act, 68 of 2008 (the “CPA”).
Entry to the competition is free. Entrants will be responsible for all costs associated with entering the competition, which may include costs, associated with SMS fees, free SMSs don’t apply.
Personal information provided by an entrant to Brito’s for the purpose of entering the competition will be collected and used in a de-identified manner. Personal information collected will be kept strictly confidential and will not be sold, rented, loaned, or otherwise disclosed to any third party. By entering this competition, you authorise the promoters to collect, store, and use (not share) personal information of the participants.
This competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this competition:
- Any employee of Brito’s
- People who are not legal residents and/or legal citizens of the Republic of South Africa
- Spouse, life partner, parent, child, brother, sister, business partner, or associate of any Brito’s employee
The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
The closing time for entering the competition will be specified.
The draw will be facilitated by a random number generator.
Prize winners will be contacted within seven (7) days of the draw by mobile number supplied by the entrant via the SMS competition entry.
Prizes are not redeemable for cash or an alternative prize. Prizes are not transferable.
The winner is able to claim the prize up to 7 days after being notified; after this period, entitlement to the prize automatically expires.
